Terms and Conditions for Digital Product Download

Welcome to Nested, LLC. ("Company,""we," "us," or "our"). By downloading and usingour digital product(s) and printed product(s) (the "Product"), youagree to be bound by these Terms and Conditions (the "Terms"). Pleaseread them carefully before completing your purchase or download.
1. Acceptance of Terms
By downloading or using the Product, you agree to theseTerms and our Privacy Policy. If you do not agree with these Terms, do notproceed with the download and/or do not proceed with printing the product.
2. License Grant
Subject to your compliance with these Terms, Nested, LLC.grants you a non-exclusive, non-transferable, revocable license to download,install, and use the Product for personal, non-commercial use. You may not usethe Product for any purpose that is unlawful or prohibited by these Terms.
3. Ownership
The Product and all related intellectual property rights areowned by Nested, LLC. or its licensors. You do not acquire any ownership rightsin the Product by downloading or using it.
4. Restrictions
You agree not to:
- Copy, modify, distribute, or create derivative works based on the Product, unless you purchase the BIM or CAD package. If you purchase the BIM or CAD package, you may create a modified work from the product licensed. Said modified work may not be sold or licensed, and may not be used for commercial use. Said modified work may be distributed to project contractors or subcontractors in PDF format.
- Sell, rent, lease, or sublicense the Product.
- Reverse engineer, decompile, or disassemble the Product.
- Remove or alter any copyright, trademark, or other proprietary notices contained in the Product.
5. Payment and Refunds
All payments for the Product are final. We do not offerrefunds for digital product purchases, except as required by law or in cases oftechnical issues that we are unable to resolve.
6. Support and Updates
We may provide updates or support for the Product at ourdiscretion. We are not obligated to provide updates, but if we do, they will besubject to these Terms.
7. Termination
We may terminate or suspend your access to the Product ifyou violate these Terms. Upon termination, you must immediately cease all useof the Product and delete it from your devices.
8. Disclaimer of Warranties
The Product is provided "as is" without anywarranties of any kind, whether express or implied. We do not warrant that theProduct will meet your requirements or be error-free.
9. Limitation of Liability
To the fullest extent permitted by law, Nested, LLC., or itslicensors, executors, partners or shareholders shall not be liable for anyindirect, incidental, special, consequential, or punitive damages arising outof or related to your use of the Product, even if we have been advised of thepossibility of such damages.
10. Indemnification
You agree to indemnify, defend, and hold harmless Nested,LLC. and its affiliates from any claims, liabilities, damages, losses, andexpenses, including reasonable attorneys' fees, arising out of or related toyour use of the Product or violation of these Terms.
11. Changes to Terms
We may update these Terms from time to time. We will notifyyou of any significant changes, and your continued use of the Product aftersuch changes constitutes your acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordancewith the laws of Washington State, without regard to its conflict of lawsprinciples. Any disputes arising under or in connection with these Terms shallbe subject to the exclusive jurisdiction of the courts in Washington State,United States of America.

14. Entire Agreement
These Terms constitute the entire agreement between you andNested, LLC. regarding the use of the Product and supersede all prioragreements and understandings, whether written or oral, related to the Product.
