Terms and Conditions for Digital Product Download

Effective Date: January 24, 2025

Welcome to Nested, LLC. ("Company," "we," "us," or "our"). By downloading and using our digital product(s) and printed product(s) (the "Product"), you agree to be bound by these Terms and Conditions (the "Terms"). Please read them carefully before completing your purchase or download.

1. Acceptance of Terms

By downloading or using the Product, you agree to these Terms and our Privacy Policy. If you do not agree with these Terms, do not proceed with the download and/or do not proceed with printing the product.

2. License Grant

Subject to your compliance with these Terms, Nested, LLC. grants you a non-exclusive, non-transferable, revocable license to download, install, and use the Product for personal, non-commercial use. You may not use the Product for any purpose that is unlawful or prohibited by these Terms.

3. Ownership

The Product and all related intellectual property rights are owned by Nested, LLC. or its licensors. You do not acquire any ownership rights in the Product by purchasing, downloading or using it.

4. Restrictions

You agree not to:

a. Duplicate, replicate or otherwise copy the home plans or files.

b. Use the plan for more than one (1) construction project. If you want to build more than one home with the plan, you must purchase a plan for each build.

c. Hold us accountable for any communications before or after purchase of the plans.

d. Copy, modify, distribute, or create derivative works based on the Product, unless you purchase the BIM or CAD package. If you purchase the BIM or CAD package, you may create a modified work from the product licensed. Said modified work may not be sold or licensed, and may not be used for commercial use. Said modified work may be distributed to project contractors or subcontractors in PDF format.

e. Sell, rent, lease, or sublicense the Product.

f. Reverse engineer, decompile, or disassemble the Product in any way that is not solely for the purpose of constructing the home.

g. Remove or alter any copyright, trademark, or other proprietary notices contained in the Product.

You understand that:

a. These plans do not contain mechanical, electrical, plumbing, civil or structural engineering. The requirements for your project will be determined with your local permitting body. We may help coordinate this effort depending on your circumstances and location, but we do not guarantee this as a service.

b. We do not warranty the information or quality of the plan and are not obliged to provide further materials, plans or information to you beyond checkout. Any such service is voluntary on our behalf.

5. Payment and Refunds

All payments for the Product are final. We do not offer refunds for digital product purchases, except as required by law or in cases of technical issues that we are unable to resolve.

6. Support and Updates

We may provide updates or support for the Product at our discretion. We are not obligated to provide updates, but if we do, they will be subject to these Terms.

7. Termination

We may terminate or suspend your access to the Product if you violate these Terms. Upon termination, you must immediately cease all use of the Product and delete it from your devices.

8. Disclaimer of Warranties

The Product is provided "as is" without any warranties of any kind, whether express or implied. We do not warrant that the Product will meet your requirements or be error-free.

9. Limitation of Liability

To the fullest extent permitted by law, Nested, LLC., or its licensors, executors, partners or shareholders shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Product, even if we have been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless Nested, LLC. and its affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Product or violation of these Terms.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of any significant changes, and your continued use of the Product after such changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Washington State, without regard to its conflict of laws principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Washington State, United States of America.

14. Entire Agreement

These Terms constitute the entire agreement between you and Nested, LLC. regarding the use of the Product and supersede all prior agreements and understandings, whether written or oral, related to the Product.
